LUCKY NUMBER GAME Official Rules NO PURCHASE NECESSARY. VOID IN FLORIDA AND WHERE PROHIBITED. THE LYCOS "LUCKY NUMBER GAME" ("PROMOTION") STARTS AT 11:00:00 P.M. (EASTERN TIME) ON NOVEMBER 17, 1999 AND ENDS AT 10:59:59 P.M. (EASTERN TIME) ON DECEMBER 30, 1999. CONFIRMATION E-MAILS SENT IN THE PROMOTION DO NOT CONSTITUTE LOTTERY TICKETS. THE $5,000,000 GRAND PRIZE WILL NOT BE AWARDED IN THE UNCLAIMED PRIZE DRAWING. ELIGIBILITY: The Promotion is only open to legal U.S. residents (except residents of Florida) 18 years of age or older who enter via the Internet from the United States. Employees, officers and directors of Lycos, Cohen-Friedberg Associates/C.O.M.P., their affiliates, subsidiaries, advertising, promotion, fulfillment and marketing agencies, their immediate families, (defined as spouse, children, siblings, parents, or grandparents) and those with whom such persons reside are NOT eligible. By participating, entrants agree to these "Official Rules" and to the decisions of the judges, which are final and binding in all respects. HOW TO ENTER: To participate in the Promotion, you must be registered for My Lycos. Registration is free. Visit http://www.lycos.com/numbers ("Promotion Page") and, if you have not already done so, register for My Lycos. All entrants, including those already registered for My Lycos, must provide additional information, including complete address, daytime telephone number and e-mail address, and confirm that they have read the Official Rules. THE DATA ENTERED MUST BE ACCURATE FOR YOUR ENTRY TO BE ELIGIBLE. IF INACCURATE INFORMATION IS SUPPLIED, YOU WILL NOT BE ELIGIBLE TO WIN ANY PRIZE. If you have entered inaccurate information in registering for My Lycos, you may click on the appropriate button on the Promotion Page and resubmit accurate information. Upon submitting the foregoing information, you will be sent to the Entry Page. To go to the Entry Page on subsequent days after submitting the foregoing information, log in to My Lycos and click on the link to the Entry Page. On the Entry Page, select and enter, in any order, six (6) numbers ("Selected Numbers") from 1 to 30 in the on-line entry form. Do not duplicate any number in your entry. Your entry of Selected Numbers ("Entry") will be recorded in the exact order entered. All Entries must be received daily prior to 10:59:59 p.m. E.S.T. to qualify for that day’s game. Entries received after the 10:59:59 p.m. E.S.T. deadline will be automatically entered in the next day’s game. The final deadline is 10:59:59 P.M. E.S.T. on December 30, 1999. LIMIT: Four (4) Entries from any e-mail address or person (regardless of whether such person has multiple addresses, phone numbers or e-mail addresses) per each day’s game. More than four Entries from any e-mail address or person per day will void all Entries from that person or e-mail address. Entries remain eligible only for one day’s game. Entrants will receive a confirmation message by e-mail confirming their Selected Numbers and the day on which the Selected Numbers are valid. In the event that the numbers in the confirmation message differ from the Selected Numbers stored in Lycos’ database, the Selected Numbers stored in Lycos’ database will control. At the conclusion of the Promotion period, all eligible Entries are automatically entered into a random drawing for unclaimed prizes, except the Grand Prize. Lycos and Cohen-Friedberg Associates/C.O.M.P. are not responsible for Entries not received due to lost, failed, delayed, or interrupted connections, including Internet, web server, network, or phone line connections or miscommunication, other electronic malfunctions, computer or telephone hardware or software failures, malfunctions, or garbled communications. All Entries become the sole property of Lycos and none will be returned. Entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The "authorized account holder" is the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Each potential winner may be required to provide proof that s/he is the authorized account holder of the e-mail address associated with the potentially winning Entry. SELECTION AND NOTIFICATION OF WINNERS: Beginning November 18, 1999 and continuing daily throughout the Promotion Period, a daily set of six numbers between 1 and 30 will be randomly selected and will be posted at 11:15 p.m. E.S.T. at http://www.lycos.com/numbers. All eligible Entries submitted by 10:59:59 p.m. E.S.T. that same day will be compared to the Winning Numbers. Potential winners will be notified within five (5) days of the posting of the Winning Numbers by electronic mail, with confirmation by postal mail for the Grand Prize and First Prizes. If a potential winner cannot be contacted within seven (7) days of the first attempt, that potential winner will be deemed to have forfeited the prize and the prize will be returned to the prize pool to be awarded later. On or about January 17, 2000, a random drawing ("Unclaimed Prizes Drawing") will be held to select winners of unclaimed prizes, except the Grand Prize, if any remain. All required drawings will be conducted by Cohen-Friedberg Associates/C.O.M.P. In the event that no unclaimed prizes remain, no Unclaimed Prizes Drawing will be conducted. The Grand Prize will not be awarded as part of the Unclaimed Prizes Drawing. To claim a Grand Prize, First Prize or Second Prize, a potential prize winner must execute and return within ten (10) days of receipt an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release, or the prize will be forfeited and returned to the prize pool to be awarded later. Failure to comply with these Official Rules will result in disqualification and forfeiture of any prize. Acceptance of a prize constitutes permission for Lycos to use winner's name and likeness for advertising and promotional purposes without additional compensation, unless prohibited by law. PRIZES: 1. Grand Prize. Selected Numbers must exactly match all six (6) Winning Numbers in the exact order to win the Grand Prize. One (1) Grand Prize of five million dollars ($5,000,000) will be awarded to the first entrant whose Selected Numbers match the Winning Numbers in the exact order. Prize to be paid in 25 equal annual installments with no interest. Estimated value of Grand Prize is $2,513,367.38. If multiple entrants match the Winning Numbers exactly on the same day, the Grand Prize will be divided equally among them. Only one (1) Grand Prize of five million dollars ($5,000,000) will be available during this Promotion. IF NO ONE WINS THE GRAND PRIZE DURING THE PROMOTION PERIOD, THE GRAND PRIZE WILL NOT BE AWARDED. THE GRAND PRIZE WILL NOT BE AWARDED IN THE UNCLAIMED PRIZES DRAWING. Odds of winning the Grand Prize for any single entry are approximately 1 : 427,518,000. 2. First Prize. Selected Numbers must match all six (6) Winning Numbers in any order to win a First Prize. One (1) Shopping Account will be awarded to each of the next twenty (20) First Prize winners. One (1) Stock Account will be awarded to each of the next ten (10) First Prize winners. Finally, one (1) prize of 20,000 Points will be awarded to each of the next fifty (50) First Prize winners. No additional First Prizes will be awarded. Odds of winning a First Prize are approximately 1 : 593,775 as of November 17, 1999. Odds of winning particular First Prizes will vary depending on the number of previous winners and the time Entries are received. 3. Second Prize. Any five (5) out of six (6) Selected Numbers must match the Winning Numbers in any order to win a Second Prize. Three hundred (300) Second Prizes will be awarded. Second prize is a Visa debit account of one hundred dollars ($100) redeemable at any participating LycoShop merchant (go to http://shop.lycos.com to see list of merchants) or at barnesandnoble.com. Approximate odds of winning are 1 : 23,751. 4. Third Prize. Any four (4) out of six (6) Selected Numbers must match the Winning Numbers in any order to win a Third Prize. Odds of winning a Third Prize are approximately 1 : 1827 as of November 17, 1999. Odds of winning particular Third Prizes will vary depending on the number of previous winners and the time Entries are received. 5. Fourth Prize. Any three (3) of six (6) Selected Numbers must match the Winning Numbers in any order to win a Fourth Prize. Four thousand (4,000) Fourth Prizes of 250 Lycos Reward points will be awarded valid toward merchandise rewards offered at www.rewards.lycos.com. Lycos Reward points have no cash value. Approximate odds of winning are 1 : 203. Odds of winning prizes in the Unclaimed Prize Drawing depend on the number of eligible entries received and the number of prizes already awarded. In the event that multiple winners submit winning Entries in the same category on the same day, prizes will be awarded in the order entries were received by Lycos. Entrants may win up to four (4) Second, Third or Fourth Prizes. Winners of Grand or First Prizes are ineligible for additional prizes. Approximate value of all prizes is $2,587,867.38. No prize substitution is permitted, except by Lycos, who reserves the right to substitute any prize of equal or comparable value in the event of prize unavailability. Prizes are non-transferable. Winner is responsible for all fees that may apply to Visa Debit accounts, Stock Accounts and the Travel Account. Visa Debit accounts may be used for purchases of items up to the maximum amount awarded, but not for more than the maximum balance of the account. Lycos is not responsible for goods or services purchased with any accounts awarded as prizes, and winner is responsible for obeying all applicable restrictions imposed by the travel agency or the internet stock broker company in connection with the Travel Account and Stock Accounts, respectively. Enter up to four times per day but each entry must be mailed in separate stamped envelope. All entries must be postmarked to be received by 1/10/2000. MISCELLANEOUS: By participating in this Promotion, entrants agree to release and hold harmless Lycos, Cohen-Friedberg Associates/C.O.M.P., their parent companies, subsidiaries, divisions, affiliated and related companies and all of their respective officers, directors, employees and agents from and against any and all claims or causes of action and liability of any kind in connection with entrant’s participation in the Promotion or with prizes provided hereunder. If for any reason the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, printing error, human error or any other causes beyond the control of the Lycos that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, Lycos reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion. In such event, Lycos reserves the right to award all prizes, except the Grand Prize, in a random drawing from all entries received prior to such a suspension. Any and all disputes will be resolved exclusively in the appropriate courts in the Commonwealth of Massachusetts, and subject to the laws of the Commonwealth of Massachusetts. Should there be a conflict between the laws of the Commonwealth of Massachusetts and any other laws, the conflict will be resolved in favor of the laws of the Commonwealth of Massachusetts.
